RhodeRides Terms of Service
Please read these Terms of Service carefully before using the RhodeRides platform. By creating an account or using any part of the platform you agree to be legally bound by these terms.
1. About RhodeRides
RhodeRides is an online marketplace platform operated by Leeshore Holdings, Inc., a Delaware corporation ("RhodeRides," "we," "us," or "our"). RhodeRides connects independent owners of watersports equipment ("Outfitters") with individuals seeking to rent watersports equipment ("Renters") in Rhode Island.
RhodeRides is a technology marketplace and not a rental company. RhodeRides does not own, operate, manage, or control any equipment listed on the platform. RhodeRides does not employ Outfitters and is not responsible for the actions, omissions, equipment, or conduct of any Outfitter or Renter. All rental transactions are independent agreements entered into directly between Outfitters and Renters. RhodeRides acts solely as a neutral technology intermediary that facilitates connections between Outfitters and Renters.
2. Acceptance of Terms
By accessing or using the RhodeRides platform including our website at rhoderides.com, our mobile applications, or any related services you agree to be bound by:
- These Terms of Service
- The RhodeRides Privacy Policy
- The RhodeRides Cancellation Policy
- If you are a Renter: the RhodeRides Renter Waiver and Release of Liability
- If you are an Outfitter: the RhodeRides Outfitter Agreement and Assumption of Liability
All of the above documents are incorporated into these Terms of Service by reference and form a single binding legal agreement between you and RhodeRides.
3. Eligibility
To use the RhodeRides platform you must:
- Be at least 18 years of age
- Be a legal resident of or physically located in the United States
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the platform under any applicable law
- Have a valid Google account for authentication purposes
By creating an account you represent and warrant that you meet all eligibility requirements. RhodeRides reserves the right to verify eligibility at any time and to suspend or terminate accounts that do not meet these requirements.
4. Account Registration
You must create an account to access most features of the RhodeRides platform. Accounts are created using Google Sign-In. You agree to provide accurate, current, and complete information during registration including your legal name, phone number, and any other information requested. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify RhodeRides immediately at support@rhoderides.com if you suspect unauthorized access to your account. You may not create more than one account or create an account on behalf of another person without their explicit consent. You must be at least 18 years old to create an account.
5. User Roles
Renters browse listings and submit booking requests to rent watersports equipment from Outfitters. Renters must accept the RhodeRides Renter Waiver before submitting their first booking request.
Outfitters list watersports equipment for rent on the platform. Outfitters must accept the RhodeRides Outfitter Agreement before their first listing goes live. Outfitters must complete Stripe Express account setup before they can confirm bookings and receive payments.
A single user may be both a Renter and an Outfitter simultaneously. Each role carries its own separate obligations as described in the applicable agreements.
6. The RhodeRides Marketplace
How it works:
- Outfitters create listings describing their equipment, pricing, availability, and pickup details.
- Renters browse listings and submit booking requests including preferred dates, duration, and quantity.
- Outfitters review booking requests and confirm or decline them.
- Upon confirmation Renters complete payment through the RhodeRides platform.
- Upon successful payment pickup instructions are shared with the Renter through the platform messaging system.
- Renters and Outfitters coordinate pickup and return directly through the RhodeRides messaging system.
RhodeRides is not a party to any rental agreement between an Outfitter and a Renter. RhodeRides provides the technology platform that facilitates these connections but is not responsible for the performance of either party in any rental transaction.
7. Platform Fees
Listing gear on RhodeRides is free for Outfitters.
RhodeRides charges a service fee of 10% of the rental price on each completed transaction. This fee is added to the rental price and charged to the Renter at checkout. Outfitters receive 90% of their listed rental price for each completed booking.
All payments are processed through Stripe. Stripe's standard processing fee of 2.9% plus $0.30 per transaction is deducted from the platform fee. This does not affect the amount received by Outfitters or the amount charged to Renters beyond the disclosed service fee.
RhodeRides reserves the right to modify its fee structure at any time with 30 days notice to affected users. Service fees are non-refundable except in cases where an Outfitter cancels a confirmed booking, in which case the full amount including service fees is refunded to the Renter.
8. Payments
All payments on the RhodeRides platform are processed through Stripe, a third party payment processor. By using the platform you agree to Stripe's Terms of Service available at stripe.com/legal. Renters authorize RhodeRides to charge their payment method for the full rental amount plus the applicable service fee at the time of payment. Outfitters must complete Stripe Express account setup including identity verification and bank account connection before they can receive payouts. Payouts to Outfitters are processed by Stripe on a standard rolling schedule typically 2 business days after payment is received. RhodeRides is not responsible for payment failures, declined cards, or delays in payouts caused by Stripe, banking institutions, or incomplete account verification. All prices on the platform are listed in US Dollars.
9. Cancellations and Refunds
The following cancellation policy applies to all bookings made through the RhodeRides platform:
Renter cancellations:
- More than 24 hours before rental start: Full refund of rental amount and service fee
- Between 2 and 24 hours before rental start: 50% refund of rental amount. Service fee is non-refundable.
- Less than 2 hours before rental start: No refund
Outfitter cancellations:
- If an Outfitter cancels a confirmed booking for any reason: Full refund to Renter including service fee
- Repeated Outfitter cancellations may result in account suspension
Weather cancellations:
- Weather cancellations are handled at the Outfitter's discretion
- RhodeRides recommends Outfitters offer full refunds for unsafe weather conditions
- RhodeRides is not responsible for weather related cancellations or refunds
Refunds are processed through Stripe and may take 5-10 business days to appear on your statement.
10. Prohibited Conduct
You agree not to use the RhodeRides platform to:
- Violate any applicable law, regulation, or third party rights
- Provide false, inaccurate, or misleading information in listings or communications
- List equipment you do not own or have the legal right to rent
- Conduct rental transactions outside of the RhodeRides platform to circumvent platform fees
- Harass, threaten, or discriminate against any other user
- Discriminate against Renters or Outfitters on the basis of race, color, religion, national origin, sex, disability, familial status, or any other protected characteristic
- Introduce malware, viruses, or any other harmful code to the platform
- Attempt to gain unauthorized access to any part of the platform or any other user's account
- Scrape, crawl, or systematically extract data from the platform without written permission
- Use the platform for any fraudulent or illegal purpose
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- List stolen, illegally obtained, or legally encumbered equipment
- Allow minors to use rented equipment without appropriate adult supervision
- Sublet rented equipment to any third party
Violation of any prohibited conduct may result in immediate account suspension or termination and may be reported to appropriate law enforcement authorities.
11. Equipment Standards
All equipment listed on RhodeRides must meet the following standards:
- Equipment must be accurately described including type, condition, dimensions, and any relevant specifications
- Equipment must be in safe working condition fit for its intended watersports purpose
- Equipment must comply with all applicable safety regulations and standards
- Equipment must not be listed if it is unsafe, structurally compromised, or not fit for use
- Outfitters must update listings immediately if equipment condition changes materially
RhodeRides reserves the right to remove any listing that does not meet these standards.
12. Communications
All communications between Renters and Outfitters must take place through the RhodeRides platform messaging system. You agree to receive transactional notifications from RhodeRides including booking confirmations, payment receipts, and account updates via email and SMS to the contact information provided in your account. You may opt out of non-transactional marketing communications at any time through your account settings. RhodeRides monitors platform communications for safety, fraud prevention, and compliance purposes. By using the platform messaging system you consent to this monitoring. You must not share personal contact information including phone numbers or email addresses in platform messages before a booking is confirmed and paid.
13. Reviews and Ratings
Following a completed rental RhodeRides may invite Renters and Outfitters to leave reviews of their experience. Reviews must be honest, accurate, and based on your direct experience with the rental. Reviews must not contain defamatory, harassing, or discriminatory content. RhodeRides reserves the right to remove reviews that violate these guidelines. RhodeRides does not verify the accuracy of reviews but reserves the right to investigate and remove fraudulent reviews.
14. Intellectual Property
The RhodeRides platform including its design, code, trademarks, logos, and content is owned by Leeshore Holdings, Inc. and is protected by applicable intellectual property laws. By listing equipment on RhodeRides you grant RhodeRides a non-exclusive, royalty-free, worldwide license to use, display, and distribute photos and descriptions you upload to the platform for the purpose of operating and promoting the platform. You represent that you own or have the right to use all content you upload to the platform and that such content does not infringe any third party intellectual property rights. You may not copy, modify, distribute, or create derivative works from the RhodeRides platform without written permission from Leeshore Holdings, Inc.
15. Privacy
Your use of the RhodeRides platform is subject to our Privacy Policy which is incorporated into these Terms of Service by reference. By using the platform you consent to the collection and use of your information as described in the Privacy Policy.
Key privacy commitments:
- We collect only the information necessary to operate the platform
- We never sell your personal information to third parties
- We share your information only as necessary to facilitate rental transactions and comply with legal obligations
- We use industry standard security measures to protect your information
- Your phone number is used only for booking notifications and is never shared publicly
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- RHODERIDES AND LEESHORE HOLDINGS, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY RENTAL TRANSACTION FACILITATED THROUGH THE PLATFORM.
- RHODERIDES' TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL PLATFORM FEES PAID BY OR TO YOU IN THE THREE MONTHS PRECEDING THE CLAIM.
- RHODERIDES IS NOT LIABLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS ARISING FROM THE USE OF EQUIPMENT RENTED THROUGH THE PLATFORM.
- RHODERIDES IS NOT LIABLE FOR ANY EQUIPMENT DEFECTS, INACCURATE DESCRIPTIONS, OR MISREPRESENTATIONS MADE BY OUTFITTERS.
- RHODERIDES IS NOT LIABLE FOR ANY FAILURE BY A RENTER TO PAY FOR DAMAGES OR HONOR THEIR OBLIGATIONS UNDER THE RENTER WAIVER.
- RHODERIDES IS NOT LIABLE FOR ANY THIRD PARTY CLAIMS ARISING FROM RENTAL TRANSACTIONS FACILITATED THROUGH THE PLATFORM.
- RHODERIDES IS NOT LIABLE FOR ANY INTERRUPTION, SUSPENSION, OR TERMINATION OF THE PLATFORM OR ANY LOSS OF DATA ARISING THEREFROM.
17. Indemnification
You agree to indemnify, defend, and hold harmless RhodeRides, Leeshore Holdings, Inc., and their respective officers, directors, shareholders, employees, agents, successors, and assigns from and against any and all claims, actions, suits, proceedings, costs, expenses, damages, and liabilities including reasonable attorneys fees arising out of or related to:
- Your use of the RhodeRides platform
- Your breach of these Terms of Service or any incorporated agreement
- Your violation of any applicable law or regulation
- Any rental transaction you participate in as an Outfitter or Renter
- Any content you upload to the platform
- Any injury or damage caused by equipment you list or rent
18. Dispute Resolution
Between Users:
RhodeRides is not responsible for resolving disputes between Outfitters and Renters. We encourage users to resolve disputes directly through the platform messaging system. RhodeRides may provide booking records, messaging history, and payment records to assist in dispute resolution but is not obligated to adjudicate disputes or enforce outcomes.
Between You and RhodeRides:
Any dispute between you and RhodeRides arising out of or related to these Terms of Service or your use of the platform shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration shall take place in Providence, Rhode Island. You waive your right to participate in any class action lawsuit or class-wide arbitration against RhodeRides or Leeshore Holdings, Inc. Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
19. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Rhode Island without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in Providence County, Rhode Island for any disputes not subject to arbitration.
20. Modifications to Terms
RhodeRides reserves the right to modify these Terms of Service at any time. Material changes will be communicated to users via email and through a notification on the platform with at least 30 days notice before taking effect. Your continued use of the platform after the effective date of any modification constitutes your acceptance of the modified terms. If you do not agree to the modified terms you must stop using the platform and close your account. The current version of these Terms of Service is always available at rhoderides.com/terms.
21. Termination
You may terminate your account at any time through your account settings or by contacting support@rhoderides.com. RhodeRides reserves the right to suspend or terminate your account at any time for violation of these Terms of Service or for any conduct we determine in our sole discretion is harmful to the platform or its users. Upon termination your right to use the platform ceases immediately. Any pending bookings at the time of termination will be handled on a case by case basis. Sections of these Terms that by their nature should survive termination including limitation of liability, indemnification, and dispute resolution shall survive termination.
22. Geographic Restrictions
The RhodeRides platform is currently available exclusively in Rhode Island. Use of the platform outside of Rhode Island may be subject to additional restrictions. RhodeRides reserves the right to expand or restrict geographic availability at any time.
23. Insurance Disclaimer
RhodeRides does not provide insurance of any kind including liability insurance, equipment insurance, personal injury insurance, or any other coverage for rental transactions facilitated through the platform. Both Outfitters and Renters are strongly encouraged to obtain appropriate insurance coverage for their activities. RhodeRides recommends that Outfitters obtain general liability insurance covering their rental activities.
24. Severability
If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
25. Entire Agreement
These Terms of Service together with the RhodeRides Renter Waiver, Outfitter Agreement, Cancellation Policy, and Privacy Policy constitute the entire agreement between you and RhodeRides with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.
