RhodeRides Rental Waiver, Release of Liability, and Assumption of Risk Agreement

Please read this agreement carefully before booking. By checking the acceptance box you agree to be legally bound by its terms.

1. Nature of RhodeRides

RhodeRides is a technology marketplace operated by Leeshore Holdings, Inc. that connects independent gear owners ("Outfitters") with individuals seeking to rent watersports equipment ("Renters"). RhodeRides is not a rental company, does not own any equipment listed on the platform, and does not employ Outfitters. All rental transactions are independent agreements between Renters and Outfitters. RhodeRides acts solely as a neutral technology intermediary.

2. Assumption of Risk

By booking through RhodeRides you voluntarily acknowledge and accept that:

a) Watersports activities including but not limited to surfing, paddleboarding, kitesurfing, wing foiling, and kayaking carry inherent risks of serious bodily injury, permanent disability, and death.

b) These risks exist regardless of the condition of the equipment, the skill level of the participant, weather conditions, water conditions, and the presence or absence of other people in the area.

c) You are voluntarily participating in these activities with full knowledge of the risks involved.

d) You have the appropriate skill, experience, and physical fitness required to safely operate the rented equipment.

e) You have inspected the equipment at the time of pickup and confirmed it is in acceptable condition for your intended use. Failure to inspect the equipment before use constitutes acceptance of its condition.

3. Equipment Responsibility

By accepting rental equipment from an Outfitter you agree that:

a) You take full legal custody and responsibility for the equipment from the time of pickup until the time of return.

b) You are responsible for any and all damage to the equipment that occurs during your rental period regardless of cause, except as provided in Section 7 (Outfitter Defects).

c) You are responsible for returning the equipment in the same condition as received, subject to normal wear and tear.

d) You agree to immediately report any damage, loss, or theft of the equipment to the Outfitter through the RhodeRides platform.

e) If the equipment is lost, stolen, or damaged beyond repair during your rental period you are responsible for the full replacement value of the equipment as determined by the Outfitter.

f) You agree to pay any damage deposit required by the Outfitter as disclosed on the listing prior to booking.

4. Prohibition on Subletting

You agree that:

a) The rental agreement is solely between you and the Outfitter. You may not sublet, loan, share, or transfer use of the rented equipment to any third party under any circumstances.

b) If you allow any third party to use the rented equipment you remain fully liable for:

  • Any damage to the equipment caused by the third party
  • Any injury caused to the third party by the equipment
  • Any injury caused by the third party to other persons using the equipment
  • Any injury caused by the third party to you using the equipment
  • Any damage caused by the third party to property belonging to others

c) Allowing a third party to use rented equipment is a material breach of this agreement and the Outfitter may hold you fully liable for all resulting damages.

5. Third Party Claims and Liability

You agree that:

a) If you injure a third party while using rented equipment you are solely liable for any resulting claims, damages, medical costs, legal fees, or judgments.

b) If rented equipment fails or breaks during normal use and causes injury to a third party the liability between you and the Outfitter will be determined based on whether the failure resulted from equipment defect (Outfitter liability) or misuse (Renter liability). RhodeRides bears no liability in either case.

c) If a third party interferes with, damages, or steals the rented equipment while in your custody you remain responsible for that equipment and must seek recourse directly against the third party. RhodeRides is not responsible for third party interference with rented equipment.

d) If a third party is injured in the vicinity of your rental activity due to their own actions or negligence RhodeRides bears no liability for any resulting claims.

e) If you damage property belonging to a third party while using rented equipment you are solely liable for the cost of repair or replacement of that property.

6. Personal Injury

You agree that:

a) You assume full risk of personal injury, illness, or death arising from your use of rented equipment.

b) You will not hold RhodeRides, Leeshore Holdings Inc., its officers, directors, employees, or agents liable for any personal injury sustained during your rental period regardless of cause.

c) You acknowledge that RhodeRides does not provide any insurance coverage for personal injury sustained during rental activities.

d) You are encouraged to obtain your own personal injury or accident insurance prior to participating in watersports activities.

7. Outfitter Equipment Defects

You acknowledge that:

a) If rented equipment fails due to a pre-existing defect that was not disclosed by the Outfitter and that failure causes injury or damage the Outfitter may bear liability for that defect.

b) You must document any equipment defect or failure immediately at the time of occurrence through the RhodeRides platform messaging system.

c) Failure to immediately document and report equipment defects may limit your ability to make a claim against the Outfitter.

d) RhodeRides bears no liability for equipment defects regardless of whether the defect was known or unknown to the Outfitter.

8. Release of Liability

To the fullest extent permitted by applicable law you hereby release, waive, discharge, and covenant not to sue RhodeRides, Leeshore Holdings Inc., and their respective officers, directors, shareholders, employees, agents, successors, and assigns from any and all claims, demands, losses, damages, costs, and expenses arising out of or related to:

  • a) Your use of any equipment rented through the RhodeRides platform
  • b) Any injury sustained by you during your rental period
  • c) Any injury caused by you to third parties during your rental period
  • d) Any damage to rented equipment during your rental period
  • e) Any damage to third party property during your rental period
  • f) Any claims arising from your subletting of rented equipment to third parties
  • g) Any dispute between you and an Outfitter

9. Indemnification

You agree to indemnify, defend, and hold harmless RhodeRides and Leeshore Holdings Inc. from and against any and all third party claims, actions, suits, proceedings, costs, expenses, damages, and liabilities including reasonable attorneys fees arising out of or related to your use of rented equipment, your breach of this agreement, or your violation of any applicable law or regulation.

10. Cancellation Policy

You acknowledge and agree to the following cancellation terms:

a) Cancellation more than 24 hours before the rental start time: Full refund of rental amount and service fee.

b) Cancellation between 2 and 24 hours before the rental start time: 50% refund of rental amount only. Service fee is non-refundable.

c) Cancellation less than 2 hours before the rental start time: No refund. Full rental amount and service fee are forfeited.

d) If an Outfitter cancels a confirmed booking for any reason the Renter will receive a full refund of all amounts paid including service fees.

e) Refunds are processed through Stripe and may take 5-10 business days to appear on your statement.

11. Weather and Conditions

a) Weather cancellations are handled at the Outfitter's discretion. Renters are encouraged to communicate with Outfitters through the RhodeRides platform regarding weather conditions prior to their rental date.

b) RhodeRides recommends Outfitters offer full refunds for cancellations due to unsafe weather conditions but does not require it.

c) RhodeRides is not responsible for any losses arising from weather related cancellations.

12. Governing Law and Dispute Resolution

a) This agreement shall be governed by the laws of the State of Rhode Island without regard to its conflict of law provisions.

b) Any dispute arising under this agreement shall be resolved through binding arbitration in Providence, Rhode Island under the rules of the American Arbitration Association.

c) You waive any right to participate in a class action lawsuit against RhodeRides or Leeshore Holdings Inc.

13. Severability

If any provision of this agreement is found to be unenforceable the remaining provisions shall continue in full force and effect.

14. Acknowledgment

By checking the acceptance box below you confirm that:

  • You are at least 18 years of age
  • You have read and understood this entire agreement
  • You voluntarily agree to be bound by its terms
  • You are not relying on any representations made by RhodeRides outside of this agreement
  • You understand this is a legally binding contract
Important: RhodeRides strongly recommends that all Renters obtain appropriate personal liability insurance and personal accident insurance prior to participating in watersports activities. RhodeRides does not provide insurance of any kind.
